Welcome to LuxLights.
These Terms of Service (“Terms”) govern your access to and use of the LuxLights website, products, services, the PLE mobile application, and all related software, content, and services provided by LuxLights LLC (“LuxLights,” “we,” “our,” or “us”).
The PLE mobile application is developed and maintained by Permanent Lighting Experts LLC and is provided to LuxLights customers as part of their lighting system experience.
By accessing our website, requesting a quote, purchasing products or services, creating an account, downloading the PLE App, or otherwise using our services, you agree to these Terms. If you do not agree, please do not use our website, products, services, or the PLE App.
1. Eligibility
You must be at least eighteen (18) years old or otherwise have the legal authority to enter into this agreement.
By using our website, services, or the PLE App, you represent that you meet these requirements.
2. Our Services
LuxLights provides permanent exterior lighting products and related installation services through LuxLights and its authorized dealers and installers.
Our website and the PLE App may allow you to:
Request estimates
Schedule appointments
Register products
View warranty information
Access installation records
Manage your lighting system
Receive notifications
Manage your customer account
Access future software features
Features may change or be added over time.
3. Quotes and Estimates
Any quote or estimate provided by LuxLights is based on the information available at the time it is prepared.
Final pricing may change due to:
Changes requested by the customer
Site conditions
Product availability
Measurement adjustments
Additional work requested
Quotes do not constitute a binding agreement until accepted by both parties.
4. Scheduling
Installation dates and appointment times are estimates.
Although we make every effort to complete projects on schedule, delays may occur due to:
Weather
Material availability
Safety concerns
Customer requests
Other unforeseen circumstances
5. Payments
Payment terms are provided at the time of purchase.
Failure to make payment when due may result in delayed installation, suspension of services, additional fees where permitted by law, or other available legal remedies.
Payments processed electronically may be handled through trusted third-party payment providers.
Financing, when offered, is provided through third-party financing partners and is subject to their terms and approval process.
6. Customer Responsibilities
Customers agree to:
Provide accurate information
Ensure reasonable access to the property
Inform us of hazards or special conditions
Obtain any required permissions or approvals (such as HOA or landlord approvals) not specifically agreed to be obtained by LuxLights
Promptly notify us of concerns regarding completed work
7. PLE Mobile Application
The PLE mobile application is provided to eligible LuxLights customers as part of their lighting system experience.
Certain features require an account.
You are responsible for:
Maintaining accurate account information
Keeping your login credentials secure
All activity that occurs under your account
App features, availability, and compatibility may change over time, and app functionality may depend on your device, operating system, and internet connection.
8. Software License
LuxLights grants you a limited, revocable, non-exclusive, non-transferable license to install and use the PLE App for your personal use in connection with your LuxLights lighting system.
This license does not transfer ownership of the App or any intellectual property.
9. Acceptable Use
You agree not to:
Violate any applicable law
Access accounts that do not belong to you
Attempt to bypass security measures
Reverse engineer, decompile, or modify the App
Upload malicious software
Interfere with the operation of our systems
Misrepresent your identity
Create fraudulent accounts
Attempt unauthorized access to our servers
Use automated tools to scrape or harvest information without permission
Violation of these Terms may result in suspension or termination of your account.
10. User Content
The PLE App may allow you to upload content, including photographs, notes, warranty documentation, or other project-related information.
You retain ownership of your content.
By uploading content, you grant LuxLights LLC and Permanent Lighting Experts LLC a limited, worldwide, non-exclusive, royalty-free license to host, store, process, display, and transmit that content solely for operating, maintaining, improving, and supporting our products and services.
11. Intellectual Property
All content available through our website and the PLE App—including software, source code, graphics, photographs, logos, icons, text, documentation, designs, trademarks, and branding—is owned by LuxLights LLC, Permanent Lighting Experts LLC, or their licensors and is protected by applicable intellectual property laws.
Except as expressly permitted, you may not copy, modify, reproduce, distribute, publish, or create derivative works from our content without prior written permission.
12. Third-Party Services
Certain features rely on third-party providers, including payment processors, authentication services, cloud hosting, messaging platforms, and notification services.
Your use of those services may also be governed by their respective terms and privacy policies.
LuxLights is not responsible for the availability, security, or performance of third-party services.
13. Software Updates
The PLE App may periodically receive:
Bug fixes
Security updates
Performance improvements
New features
Some updates may be required for continued use of certain features.
14. Warranty
Warranty coverage is governed by the written LuxLights warranty provided at the time of installation.
Nothing within these Terms modifies or expands any written warranty unless expressly stated.
15. Disclaimer
Except where prohibited by law, our website, the PLE App, and related software are provided “AS IS” and “AS AVAILABLE.”
We make no guarantee that they will always be uninterrupted, error-free, or available at all times.
16. Limitation of Liability
To the fullest extent permitted by law, LuxLights LLC, Permanent Lighting Experts LLC, their officers, employees, contractors, affiliates, licensors, and suppliers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from your use of our website, products, services, or the PLE App.
Where permitted by law, our total liability for any claim shall not exceed the amount you paid directly to LuxLights for the applicable products or services giving rise to the claim.
17. Indemnification
You agree to defend, indemnify, and hold harmless LuxLights LLC and Permanent Lighting Experts LLC from any claims, damages, liabilities, costs, or expenses arising from:
Your use of our website or the PLE App
Your violation of these Terms
Your uploaded content
Your violation of applicable law
Your infringement of another person’s rights
18. Governing Law
Before pursuing formal legal action, we encourage you to contact us first so we can attempt to resolve any concern directly and in good faith.
These Terms shall be governed by the laws of the State of Utah without regard to conflict of law principles.
Any legal action arising from these Terms shall be brought exclusively in the state or federal courts located in Utah.
19. Changes to These Terms
We may update these Terms from time to time.
When changes are made, the revised version will be posted on this page with a new Effective Date.
Your continued use of our website, services, or the PLE App after those changes constitutes acceptance of the revised Terms.
